State and Territory Contacts, Links and Documents for Advance Care Planning
Across Australia, every competent adult has the right to consent to and to refuse medical treatment. This right is the fundamental basis of advance care planning.

In Australia, the law comes from two sources: decisions made by the courts (Common Law) and laws passed by Parliament (Statute Law). All States and Territories have statute laws regarding guardianship. All have statutes enabling the appointment of a substitute decision maker for medical treatment. All, except Tasmania, but with significant variations, have statutory documents regarding advance care directives or refusal of medical treatment.

About Us - "Advance Care Planning Australia" (ACPA)
ACPA initiatives are delivered by Victoria's Austin Health (ABN 96 237 388 063) with the support of the Commonwealth Department of Health, designed to offer premier resources for national collaboration.
ACPA is not a separate organisation, rather a vehicle for identifying advance care planning activities of shared need regardless of location, interests or model of care. Currently these include:
- this website;
- Australia's annual Advance Care Planning and End of Life Care National Conference each November; and
- the annual Marion Seal Oration Award recognising excellence in the field.
